Currently in the process of doing business the use of certain objects of intellectual property (IP) takes place quite often. The first and foremost associations arise with the use of trademarks and service marks.

However, the concept of intellectual property includes many other IP objects (industrial designs, utility models, inventions, etc.), and also covers a wide range of issues: from creation of IP objects, their use and transfer (cession) of rights to other persons, to legal protection in the event of unfair competition.

In this regard it is extremely important to carry out the full range of measures aimed at the legalization of legal rights to the objects of intellectual property being created/used in a timely and appropriate manner. After all, it is the very case where legal protection of such rights will be carried out.

Key activities

Within the framework of the intellectual property subpractice the lawyers of Lovtsov Klochko & Partners have considerable positive experience and the highest level of competence and therefore provide legal services in the following key areas:

  • Providing verbal and written advice on the creation (registration), use and assignment of rights to IP objects;
  • Drawing up all the documents required for registration of trademarks, service marks under the national registration system in the Republic of Belarus, as well as under the international registration system;
  • Drawing up all the documents required for obtaining certificates and patents for industrial property objects (industrial designs, utility models, inventions) in the national patent body;
  • Legal due diligence in relation to the IP objects used (trademarks, service marks and others), verification of the legal rights to use them, as well as possible restrictions / encumbrances;
  • Development and legal review of licensing agreements, as well as agreements on the creation, use and transfer (assignment) of rights of IP objects, representing clients at the National Center for Intellectual Property of the Republic of Belarus during their registration;
  • Development and legal review of agreements on the transfer of a complex business license (franchise), representing clients at the National Center for Intellectual Property of the Republic of Belarus during their registration;
  • Drawing up documents and representing the Clients’ interests during the registration of computer programs at the National Center for Intellectual Property of the Republic of Belarus;
  • Assistance in the protection of rights of IP objects in cases of unfair competition in relation to it by the third parties.

The provision of legal services is paid on the basis of the cost and pricing principles previously agreed with the Client, namely: either on the basis of a fixed cost of services, or on the basis of a “budget” determining the allowable minimum and maximum cost limits, or on actual labour costs.

Payments are carried out on the basis of an invoice as well as Certificate of services rendered (if payment is made upon completion of the services rendering).
